Pepper V Hart

Hansard is the official daily report of parliamentary debates and the record of what was said during the introduction of legislation. As one of the external aids, referencing to Hansard can help the courts to discover how Parliament intended the law to apply and put that into practice. Initially such documents could not be consulted for the purpose of statutory interpretation. In 1992 the House of Lords delivered a blockbuster in the case of Pepper v Hart [1992], which overturned the rule against consulting Hansard.However, more and more people argue that its drawbacks outweigh its advantages. The case of Pepper v Hart was between teachers at a fee-paying school and the Inland Revenue, and concerned the tax which employees should have to pay on perks. The school allowed its teachers to send their sons there for one-fifth of the usual fee. Since the amount paid by teachers covered only the extra cost rather than the school’s fixed costs, the perk cost the school little or nothi ng, and so they maintained that they should not have to pay tax on its.Nonetheless the Inland Revenue disagreed and argued that according to tax law the perk should be taxed on the basis of the amount its saved the teachers on the real cost of sending their children to the school. The reason why the issue of consulting parliamentary debates arose was that, during the passing of the Finance Act 1976, the then Secretary to the Treasury, Robert Sheldon, had specifically mentioned the kind of situation that arose in Pepper v Hart. He had stated that where the cost to an employer of a perk was minimal, employees should not have to pay tax on the full cost of it.By a six to one majority the House of Lords decided to allow reference to be made to Hansard. The permission was made in limited circumstances. First, legislation is ambiguous, or leads to an absurdity; Second, the material relied upon consists of statements by a minister or other promoter of the Bill. Third, the statements relied upon are clear. The main advantage of referencing Hansard is it can help to prevent the absurdity and injustice caused by the literal rule. When interpreting a tatute the courts can consult Hansard to see what a Minister had said about a piece of legislation in order to decide what Parliament had intended. This permission causes the effect that the literal meaning of the statute is not followed, which may help the courts to present more proper statutory interpretation. However, many people hold opposite opinion on the use of this source. A practical objection by the dissenting justice lord Mackay was the expense both in terms of time and money will add to litigation.If debates were to be used, there was a danger that the lawyers arguing a case would devote too much time and attention to ministerial statement. Lord Steyn (2001) criticized that the counsel were expected to read all the debates in Hansard, which would add greatly to the time and expense involved in preparing cases. He suggests that much of the work of the courts is now concerned with the interpretation of documents such as statutes rather than the examination of precedents. The evidence in Hansard may be lack of clarity.The House of Lords directed that the evidence provided by the parliamentary debates might not be reliable and contain ‘conducive to a clear and unbiased explanation of the meaning of statutory language. ’ Moreover, it is difficult to discover the nature of parliamentary from the Hansard. Pepper v Hart seems to confuse the statement made by a minister or promoter of the bill with the intention of the legislature. Lord Steyn points to the nature of the parliamentary process: there are not ideal conditions for the making of authoritative statements about the meaning of a clause in a Bill.In truth a Minister speaks for the Government and not for Parliament. The statements of a Minister are no more than indications of what the Government would like the law to be. ’ Nowadays there is a trend that reference to Hansard can be found in every other case involving interpretation and construction of enactments often without any serious application of mind concerning their relevance or conformity with the aid down in Pepper v Hart. The advancement in technology is definitely a major factor contributing to this trend as it makes referencing much easier.However, electronic access relates only to recent years; for any other research one has to overcome the appalling indexing for Hansard. Overall, though allowing references to Hansard has an additional aid to interpretation is welcome, references to Hansard can give rise to further ambiguity i. e. legislation being found to be incorrect. Also, it is very costly in time and money. Since it is arguable that its drawbacks outweigh its advantages, more strict guidelines should be adopted to prevent its overuse in order to maintain the efficiency of the legal system.

Chronister recalled knowing Mr. Rob was â€Å"the one† that night, and Mr. Rob admitted to feeling â€Å"inadequate†¦ ‘ didn't think I had a shot in hell with her. † He decided to pursue her anyway, and said they were inseparable from that night forward. After dating for six months, the couple moved in together and cohabitated for the next 12 years. During that time, they both pursued degrees, Mr. Rob in criminal law and Mrs. Chronister in Biology. Once Mrs. Chronister completed her degree in the summer of 1995, the couple decided to wed. ecause of how their bills nd property were titled, they decided that Mrs. Chronister would not take Mr. Rob's name after marriage. The couple has no children but consider their two dogs, Buster and Baxter, their children. Mr. Rob is an attorney, and Mrs. Chronister is a substance abuse counselor. When asked to identify the greatest strengths in their marriage, strength. Both feel they can go to each other with any issue, and said they have a high level of mutual respect for one another. When asked to describe conflict resolution within their marriage, Mrs.Chronister reported that while they are both strong-willed and highly opinionated individuals, they respect each other's opinions and points of view and strive to find a common ground. Mr. Rob said it's all about â€Å"negotiating. † When asked what role spirituality and faith played in the success of their marriage, Mrs. Chronister said while she is very spiritual, Mr. Rob is much more religious and attends church alone. Mrs. Chronister added that they both hold Christian values and believe you should be kind to everyone no matter what their past is.They agreed that they both strive to be good people and help others when they are in need. When asked to describe the nature of their relationship with their in-laws, they both reported that neither set of in-laws agreed with their cohabitation and that it caused tension on both sides. The couple s aid once their parents realized that they were being responsible, working adults and getting educations, they â€Å"eased up† and accepted their relationship. Mrs. Chronister said she is very close to Mr. Rob's father and was close with his mother before she passed away.Mr. Rob reported feeling close to Mrs. Chronister's parents as well. Concerning roles in the marriage and the challenges associated with those, the couple described Mr. Rob as the breadwinner but much more irresponsible with handling money. Mrs. Chronister handles all finances and pays the bills. Neither of them felt their roles created challenges; Mrs. Chronister said if something comes up where they have a major bill or a vacation to save for, Mr. Rob will give her the money to save and that he doesn't do anything irresponsible with their money.When asked about one of the biggest challenges they went through as a couple, they agreed it was Mrs. Chronister's prior addiction to methamphetamine. She reported be ing sober for 7 years and 5 months as of October 20th, 2013, but said she spiraled out of control during her active drug use. Mrs. Chronister was arrested for distributing and manufacturing methamphetamine, and served 2 h years in prison for the charges. Mr. Rob recalled Mrs. Chronister â€Å"disappearing for days weeks at a time, pawning our things†¦ she Just had no control and I felt so lost.I had no idea where my wife had gone. † Mrs. Chronister said Mr. Rob â€Å"ran around trying to save me, but he couldn't. It took me wanting to change and save myself. † She said he stood by her side through all of it, and visited her every opportunity he had while she was in prison. When asked to discuss their philosophy on marriage and what they considered to be the most important parts, Mrs. Chronister said friendship was the most important part. Mr. Rob agreed, and added that finding a common ground and compromising with each other was equally important.

Arthur Millers A View From the Bridge Essay Masculinity is a prevalent theme in Arthur Millers A View From The Bridge. The four leading male characters in the play; Eddie, Rodolpho, Marco and Alfieri; each play different roles and different types of men. Miller has represented men and masculinity in an unforgiving light in the play. It appears that it is men that confuse and create problems in the characters lives. Each characters actions are effected by the conflicting forces of determinism, where every event and situation is the inevitable result of its preceding states of affairs; and freewill. It could be said that the male characters in A View From The Bridge are not acting, but being acted upon. The main character in A View From The Bridge is Eddie. He is forty years of age, slightly overweight and is described as husky. The huskiness used in the description refers to both Eddies roughness and his strong, burly build. His age suggests experience, another masculine quality. Eddies appearance reflects his attitude, strong and intimidating. In trying to prove his masculinity, Eddie is the focus of many conversations, as he feels that he must dominate the conversation. Eddies speech is very direct, with blunt wording. He constantly uses contractions and drops the last letter off words, such as in the phrase I didnt say nothin'. Eddies language is not sophisticated in any sense. This is because Eddie spent his time working instead of getting a proper education. Eddie also comes from a working class family, which would mean that his education is limited. The conglomeration of these factors conveys Eddie to be even more masculine. It is very clear that Miller has constructed Eddie to represent the epitome of masculinity; however the character has a propensity to be acted upon rather than acted. Although Eddie is portrayed as a very masculine character, the turmoil in his mind is evident to the reader. Within himself he is trying to control his feelings, or act. Instead, it appears that the happenings around him control Eddies actions. When Eddie allows Rodolpho and Marco to stay, he is acting, as he is making the decision as the patriarchal member of the Carbone family. He has the choice of whether to accept them or not. He acts out of freewill. The best example Eddie being acted upon is when he calls Immigration about Marco and Rodolpho. At this point in the play, Eddie thinks that he has no other options. He is struggling to control his  feelings for Catherine, which on its own is an example of being acted upon. Although Eddie knows that these incestuous feelings are not acceptable, he cannot help but feel this way. Catherines developing relationship with Rodolpho is clearly testing Eddies endurance. Eddie also feels that Rodolpho is a bad influence on Catherine, as Eddie can no longer control her as he used to. Realistically, this is because Catherine is growing up more than Rodolphos influence. However, Eddie feels that the only solution is to get rid of Rodolpho. By doing this, Eddie hopes that everything will return to its original state, with him being the patriarch. Consequently, Eddie calls Immigration. It can clearly be seen that Eddie is not acting, as eliminating Rodolpho is something that is inevitable if Eddie wishes for things to return to their initial state. Rodolphos appearance in A View From The Bridge is one that is far more feminine and gentle than that of the other characters. He is described as a slim platinum blond with a nice face. His gentle features are considered womanly, and so he is not considered to be masculine. Rodolphos age can be estimated to be in the mid-twenties. This denotes a lack of life experience, another indicator towards femininity rather than masculinity. Miller has constructed Rodolpho as a much less masculine character than Eddie so as to juxtapose the two characters. Unlike Eddie, Rodolpho is a more rational character. He is more cautious in what he says. Due to this discretion, Rodolphos speech is very limited in A View From The Bridge. However, his rational behaviour does not stop Rodolpho from being more acted upon than acted. Even though Rodolpho tries to refrain from causing too much of a disturbance in America, he is visibly maddening Eddie by showing affection towards Catherine. However, Rodolpho cannot control his feelings. He stands up for his right to have a relationship with Catherine and, regardless of what Eddie does or says, Rodolpho still has these feelings for Catherine. Rodolpho does not choose to be attracted to Catherine, it simply happened. The concept that Catherine and Rodolpho both care for each other is not a matter of choice or freewill, it is clearly determinism. For this reason, Rodolpho is more acted upon than acting in A View From The Bridge. Marco is described in A View From The Bridge as a thirty-two year old square built peasant. His square build implies strength and an intimidating physique, which evokes an air of masculinity. His age puts him between Eddie and Rodolpho. Throughout the play, Marco is played as quiet, yet thoughtful. His dialogue is minimal, until the final sequence where the conflict between him and Eddie erupts. Although his dialogue is entirely different to that of Eddie, the pair are both seen as masculine characters. This is because Marco is confident with himself, and does not feel it is necessary to talk or dominate the conversation. In doing so, his confidence shines through as being masculine. Again, Marco is a character that appears, in most cases, to be more acted upon than acting. Marcos strong and silent persona allows him to understand and recognise elements in the characters more so than Eddie and Rodolpho. He sees Eddies challenging nature towards Rodolpho and challenges Eddie back. In this sense, Marcos actions are acted. He understands what is happening and uses his own freewill to make a decision of what to do. However, the final sequences are clearly an indication of how Marco is more acted upon than acting. When Marco spits in Eddies face, it is the culmination of Eddies attitude and actions that cause him to do so. After trusting Eddie, Marco has been proverbially stabbed in the back. However, Marcos reaction was eminent. Eddies ongoing dislike of both Marco and Rodolpho would eventually arrive at a confrontation. Marcos reaction was clearly determinism it was the inevitable result of its preceding states of affairs. In this way, the character of Marco is more acted upon than acting. Similarly, when Marco kills Eddie, it is inevitable. If not for Eddies death, the play would be going nowhere. Eddies sanity is questionable towards the end of A View From The Bridge. If Eddie were to survive the stabbing, there would be no closure for any of the characters. When Eddie pulls the knife out and attempts to stab Marco, it is clear that he is not thinking rationally. Marco then acts in self defence when he stabs Eddie. He knows that one of them will die in the struggle, and sees that his killing of Eddie is the only way he will come out alive. For this reason, Marco acts not out of freewill, but stabs Eddie as there is no other way for the battle to end. Hence, Marco is more  acted upon than acting. However, this attribute is not shared by all of the male characters in A View From The Bridge. The final male character in A View From The Bridge is Alfieri. Alfieri is the oldest of the characters, described as being in his fifties, turning grey and portly. His age implies much life experience, as does his generously proportioned physique. His appearance is also one of a higher class than the rest of the characters. Alfieri speaks with distinction. Unlike Marco and Eddie, who feel the need to express their masculinity, Alfieri is confident in himself, and so needs not demonstrate this through his language. For this reason, Alfieri remains to be a masculine character even though his language is very poetic and eloquent. For example, when consulting Eddie and Marco, he says To promise not to kill, is not dishonourable. As well as showing Alfieris intelligence, the statement gives his words a scale of importance. Alfieris masculinity shines through in his instructing and superior manner. Unlike the rest of the male characters in A View From The Bridge, it is felt that Alfieri is not being acted upon, but is acting. As Alfieri is not directly involved in the convoluted relationships that take place in the apartment, he has the advantage of having a less emotional reaction to the occurrences. Alfieri also has the advantage of being able to think about things rationally before offering an opinion. When attempting to guide Eddie in his turmoil, Alfieri informs him that he can take no legal action. In doing so, Alfieri is acting out of freewill. Nothing is forcing him to tell Eddie this. Theoretically, Alfieri could ignore the legal aspect and tell Eddie to take his chances. Instead, Alfieri offers his own advice, to let her go. Although Alfieris instinct to seek resolution may be seen as more acted upon than acting, his pressure in guiding Eddie to do the right thing, or lack thereof, is freewill, as Alfieri made the choice in not forcing Eddie to stop acting in the manner that he was. For this reason, Alfieri is acting more than he is acted upon. Although each of the male characters in Millers play A View From The Bridge represents a different role and different type of man, each of their actions can be seen as either an act of freewill or an act of determinism. In many  instances, it appears that there is no other way for the incident to occur. At other times, the characters make choices, exercising their freewill. As Eddie, Rodolpho and Marco are all emotionally involved in the relationships in the play; their actions tend to be acts of determinism. All three are trapped in gender roles, not wanting to appear weak. As Alfieri is more of an onlooker in the play, his actions are a result of freewill. Confident with his masculinity, he is able to decide what to do, not be forced into doing something. For this reason, the male characters in A View From The Bridge can be said to be predominantly more acted upon than acting.

His actions are lead by the theory that it is better to lead a life where rules are followed. It is your duty to obey the laws and it is your duty to always act in this manner. Consequences are not to be considered when judging a persons actions (Thiroux, Krasemann, 2012, p. 46). Inspector Javerts position in society supports his actions. This man must follow the laws set by his government, and lead his community by example. His duty was to carry out the law which are examples of rule absolutes which offer no room for exceptions (Thiroux, Krasemann, 2012, p. 87). The Inspector becomes obsessed with the capture of Jean ValJean, a criminal who must be caught and brought to justice. The film begins with the story of a man, Jean ValJean, who is first introduced to the viewer in a prison setting, where later you find out he was imprisoned for theft. After serving nine-teen years of punishment in prison for his crime he is then rewarded release on parole. Following his release he encounters another situation where he acts in contrast to those beliefs of a rule utilitarian like Javert. These contrasting characters are examples within their guiding principles. Non-Consequentialist Theories are based on the idea that consequences are not and in fact should not be a factor in determining whether the act is moral or immoral (Thiroux, Krasemann, 2012, p. 46). Where as consequentialism is based or concerned with consequences. Jean ValJeans guiding principles are more of an act utilitarian who believes that everyone should perform that act which will bring out the greatest good over bad for everyone affected by the act (Thiroux, Krasemann, 2012, p. 37). Utilitarianism is a form of Consequentialism. Javert is a rule utilitarian where his ideas are that everyone should always follow the rule or rules that will bring greater good. These ide as are contrasting because it is unsure what actions would bring greater good with or without making exceptions to the rules at hand. Javert being an official of the law encourages the importance of law within the film to avoid loosing control within his community. On one hand ValJean broke the law only to avoid the death of starvation. These situations are the basis of the conflicting approaches to morality by each main character in the film. ValJean encounters the Character of Bishop Myriel who offers him a job and teats him kindly despite his criminal background. The Bishop is a positive influence on ValJean. While working for the Bishop, he makes a promise to become a better man and redeem himself only after being caught once again for stealing silverware from the bishop. The Bishop lies to officers only to save ValJean from returning to prison. With the silver that was stolen and now a gift was he only able to accomplish his promise for a better life. ValJeans commitment led him to later became the owner of a factory and the Mayor of his city. There we are first introduced to the character of Fantine. We discover that she has a child, Cossette, who is in care with another family The Thenardiers. Fantine works hard to provide for Cossette at the factory where she is later fired from, which led to her desperate need to make money. Desperate times cause for desperate measures., like Fantine prostituting to as a mean to make money. Fantines unlawful actions lead her to encounter the Inspector Javert. Here is where the feuding theories of morality between Javert and ValJean are once brought to question once again. Should Fantines actions be justified by the idea that prostitution is wrong and unlawful, or is it okay because she must provide for Cossette and her needs? In the end the Mayors position allows Fantine to avoid prison time thus bringing about greatness for her family. His utilitarian approach to the situation causes more conflict with the Inspector who believes she should be inprisoned for breaking the law. More evidence with the personal moral theories conflicting are evident when Jean ValJean promises Fantine that he will take care of her daughter Cossette. He first must escape from Mr. Jovert who is now aware that he is a convict. Javert expressed the idea that a law breaker cannot reform therefore ValJean should not be Mayor. Javert commented on his parents also being criminals when he was a child. Once exposed ValJean escapes once again with Cossette to Paris, where they live in a convent. He feels it is his duty to carry out his promise of a better life. Reparation (prima facie) is a duty mentioned when looking at non-consequential theories (Thiroux, Krasemann, 2012, p. 54). Cossette and ValJean are able to achieve a fulfilled life with security in the city of Paris while at the convent. Cossette ultimately asks to not become a nun and persuades ValJean to live outside the convent. Willing to please Cossette, ValJean agrees to the move. Cossette attracts an admirer while exploring her new surroundings in the character Marius. Marius is a young revolutionary who asks to â€Å"Restore the Republic†. He becomes obsessed and determined to interact with Cossette, very much like he is committed to his revolution. Inspector Javert also resides in Paris where he is the newest Deputy as the reward from exposing the truth about Jean ValJean. The â€Å"cat and mouse game† between Jean ValJean and the Inspector Javert is continued in Paris when he is informed with information about the revolutionists new love interested Cossette. Marius was followed by one of ValJeans informant following the revolutionists. Javert is once again on the hot pursuit to bring ValJean to an end. He is determined to bring justice because it is the right thing for him to do. ValJean unaware of Cossettes relationship with her young suitor opens an opportunity for the Inspector to get close and finally cease the former convict. ValJean now a â€Å"reformed man† refuses to give up without a fight. In the attempt to flee once again ValJean is encountered with the dilemma of Marius and Cossettes relationship. Her relationship is troubled by the increasing resistance from the revolutionists against the Parisian army. With the city barricaded ValJean must return Marius safely to Cossette. In pursuit for Marius the army injures Cossettes love and now ValJean must flee the chaos of the city with the injured Marius. Not before once again encountering the persistant Javert. This is a turn of events that gives ValJean to turn on his predator and kill him. This doesnt happen because ValJean is said to have been merciful towards the Inspector. In the end of this tale the Inspector is surprised by the mercy ValJean showed towards him. The Inspector allowed the convict to aid the Marius to some medical attention and return to his capturer. ValJean also agreed to be turned into the Parisian officials after saving Marius. With Marius alive he would no longer have to worry about his Cossettte. Therefore fulfilling his commitment to Fantine. Upon returning Mr. Javert expressed how his guiding principles to perform his duty the right way brought him confusion when ValJean showed him mercy in the situation of life and death. Death was the only solution the Inspector had in store to this for this ending. Everything ValJean did was justified when the Inspector decided to kill himself. The Inspector never breaking the law himself saw that there were flaws to his guiding principles and could not live with himself no more. Unwilling to face the consequences he saw fit to end his life thus granting ValJean his freedom. He felt his obsession for the capture of the ValJean would see no end and haunt him forever. At this point he acknowledges the fact that ValJean is a reformed man and not an â€Å"animal† thought to have been created while in the prison system. Before ValJean was a â€Å"difficult problem† to the Inspector himself and he needed bring justice to those acts of the former Mayor. Everyday we are faced with the same if not different situations where we are asked to do the â€Å"right thing†. This is very difficult even to those who appeal to be morally or ethically correct. Rules can be to general and only act as a guide to do the greatest of good while avoiding consequences. It is also difficult in the sense that there acts or rules offer no exceptions. The story of Les Miserables proves otherwise. ValJean overcame many difficulties and while his actions may have been unlawful they did affect those around him positively. His actions in the end brought him security and loving relationship with his â€Å"daughter†, Cossette, all while ultimately keeping his promis to the Bishop Myriel and the late Fantine. His actions throughout the film prove that he is indeed a good man despite his criminal background. ValJean accomplishes reformation which seemed impossible to the characteristics of the Inspector. Ciminals should be brought to jusitice, laws are meant to be followed, under no circumstances can the law be flawed, and no exceptions are to be made. These guiding principles for the Inspector shaped his actions throughout this story. ValJeans actions show that his is a honest, caring, and loving man who is rewarded with freedom. He no longer has the fear of being caught by the Inspector and also rewarded with love from his â€Å"daughter†, Cossette. In the film ValJean states that â€Å"Love is the only future God gives us†. The guiding theories to ones ethical and moral dilemmas can be conflicting with those of others. Here we have actions based on the idea of realizing the consequences for your actions first or not thinking about any consequences and acting on what you feel to be right. Rules should always be followed with no exceptions. The belief that one should not be judged or defined by any action in particularly. Rules are important to a society bringing awareness to consequences by ones actions. It is important to not give up on ourselves because we are all capable of reformation if we want it.

Overview and Analysis of Red Bull, Its Successes and Controversies When we first started, we said there is no existing market for Red Bull but Red Bull will create it. And this is what finally came true. Dietrich Mateschitz (Dolan 2005 p.1) Red Bull ®s 1987 launch established an energy drinks market. In 2009 they continue to dominate the globally. How did they achieve? How do they plan to maintain their stronghold? In 1987, revolutionary marketing and advertising techniques coupled with fortunate circumstances enabled Red Bull to create the energy drink market. In todays diverse and ever-expanding market of 228 competitors, Red Bull is likely to lose overall global market share. Ever optimistic, Red Bull continues with extreme sports sponsorship, creating events, nurturing the Red Bull ® lifestyle, a strategic business plan including expanding into emerging markets and developing products and plans to include multi-million dollar resorts and theme parks. Red Bull ® has every reason to be confident of its future. In 2008, the worldwide Functional Drinks market was worth $26.9 billion. Relatively new and still developing, by 2013 the market is expected to expand by 64.3% to a value of $44.3 billion (Datamonitor PLC 2008), spread over three different categories: Sports, Energy, and Nutraceutical. These products aim to improve users, physically and mentally or just improve well-being (Moosa 2002; Datamonitor PLC 2008). With energy drinks being the largest sector at 47.3%, Red Bull ®, was first of its kind, holding a 29% global market share in 2008. (Datamonitor PLC 2008). Spreading its wings internationally since its birth in 1987, 2008 saw Red Bull ® GmbH worth à ¢Ã¢â‚¬Å¡Ã‚ ¬10.9 billion, selling over four billion cans worldwide in 70 countries (Mà ¼ller 2009). History Red Bull ® was the brainchild of Austrian, Dietrich Mateschitz, ex-managing director of toothpaste manufacturer Blendex, where he travelled widely, experiencing different cultures (Gschwandtner 2004). On one business trip , Mateschitz read that one of Japans highest taxpayers was Mr. Taisho, manufacturer of an energy giving drink. Later in Thailand, he learned that taxi drivers use these drinks to counter fatigue. Mateschitz also noted that the drinks ingredients lacked a patent (Gschwandtner 2004). Armed with this information, in 1984 he approached Chaleo Yoovidhya, owner of Thai company TC pharmaceuticals, producer of the Kratindang energy drink (Gschwandtner 2004). Mateschitzs concept was to form a company selling its own energy drink worldwide at a premium price (Keller 2004). Chaleo agreed, each took a 49% stake, investing half a million dollars. Chaleos son took the remaining 2%, and Mateschitz agreed to run Red Bull ® (Dolan 2005). Red Bull ® was first established in Austria. Initially wary of the products unusual ingredients, Austrias government insisted on stringent scientific safety testing. Thus, Red Bull ® was not licensed until 1987. Subsequently, this regulatory procedure proved a mixed blessing for Red Bull ® (Gschwandtner 2004). By 1990, despite high sales figures, and a lot of promotion, Red Bull ®s finances were in the black. To this point, funding had been 90% equity from the two partners and 10% bank loans (Gschwandtner 2004; Dolan 2005). Ambitious Mateschitz now believed Austria too small a market for Red Bull ®. In 1993, Red Bull ® moved into such countries as Hungary and Germany, planning to pre-market the little 250ml can by word of mouth across Europe (Gschwandtner 2004). Red Bull ®s Kraihamer commented, We do not market the product to the consumer, we let the consumer discover the product first (Keller 2004, p.119). This Buzz marketing proved highly successful, and inexpensive. Red Bull ®s controversial ingredients made it a cool fashion icon. Its mixability with vodka, coupled with extreme sports sponsorship, helped the drink tap into the young hip market (Cooney 2007; Gschwandtner 20 04). By 1997, Red Bull ® had conquered most of Europe including the UK. It then moved onto the USA, working state by state with a similar buzz technique (Hein 2001). Today Red Bull ® is now Austrias most successful brand, worth more than à ¢Ã¢â‚¬Å¡Ã‚ ¬10.9 billion, with diamond producer, Swartzkopf being worth half as much (Muller 2009). 3.0 Does Red Bull ® Revitalise the Body and Mind? Red Bull ® is billed as a drink which: à ¢Ã¢â€š ¬Ã‚ ¢ Improves physical endurance, à ¢Ã¢â€š ¬Ã‚ ¢ Stimulates metabolism and helps eliminate waste substances, à ¢Ã¢â€š ¬Ã‚ ¢ Improves overall feeling of well-being, à ¢Ã¢â€š ¬Ã‚ ¢ Improves reaction speed and concentration, à ¢Ã¢â€š ¬Ã‚ ¢ Increases mental alertness (Keller 2004). Red Bull ® is best consumed:, à ¢Ã¢â€š ¬Ã‚ ¢ At times of increased mental and physical strain, à ¢Ã¢â€š ¬Ã‚ ¢ On long sleep-inducing motorways, à ¢Ã¢â€š ¬Ã‚ ¢ During intensive working days, à ¢Ã¢â€š ¬Ã‚ ¢ Prior to demanding athletic activities, à ¢Ã¢â€š ¬Ã‚ ¢ Before tests and exams, (Redbull.com (a) [ca. 2009]). Some consumers are easily convinced of Red Bull ®s effectiveness. Nicknames such as liquid speed and liquid cocaine along with peer pressure build hype around the product (Kumar, et al. 2004). American college student Kaytie Pickett illustrates this: Maybe I think it works just because they say it works Im a slave to peer pressure (Walker [ca. 2009]). Other consumers are more sceptical. Brandweek reported in 2008 that Red Bull ® was one of the UKs lowest ranked companies in a survey of perceived brand value (Brandweek 2008). Despite the odds, studies proved the drinks effectiveness. One such study was on ten individual graduate students, five of which were given a placebo, the rest Red Bull ®. Conducted before and several hours after consumption, the results proved conclusively that: the mixture of three key ingredients of Red Bull Energy Drink used in the study (caffeine, taurine, glucuronolactone) have positive effects upon human mental performance and mood (Seidl, et al. 2000). Whereas most products spell out exactly what they do, Red Bull ® uses vague terms, Vitalizes Body and Mind (Walker [ca. 2009] p.2) relying on consumers to purchase the drink and discover its effects themselves. (Walker [ca. 2009]) 3.1 What are the ingredients in Red Bull ®? Red Bull ® 250ml cans contain; à ¢Ã¢â€š ¬Ã‚ ¢ 80mg of caffeine, à ¢Ã¢ ‚ ¬Ã‚ ¢ Taurine, à ¢Ã¢â€š ¬Ã‚ ¢ Glucuronolactone, à ¢Ã¢â€š ¬Ã‚ ¢ Sugars, à ¢Ã¢â€š ¬Ã‚ ¢ Vitamins (Keller, 2004 p.117). Taurine is Red Bull ®s most controversial ingredient. In organic form, it was discovered in the bile of a bull (Irving Sax, et al. 1987). This is the likely source of not only the name, but also rumours that it is made from Bull Testes or that it contains Bull Semen. In the drink, taurine comes in synthetic form (Redbull.com (c) [ca. 2009]; Walker [ca. 2009]). Human beings produce taurine in a form similar to that of an amino acid. During extreme physical activity, the body may require more taurine than is produced. Taurines metabolic stimulatory effects help the body work harder. (Keller 2004; Healingdaily.com 2009). Equally, its detoxifying effect helps counter fat build-up on the liver caused for example by excess binge drinking (Healingdaily.com 2009; McCall 2005). Glucuronolactone is a naturally occurring amino acid in human beings, produced by glucose b reaking down in the liver. It also removes toxins from the body and is a metabolic stimulator, fighting fatigue, and producing a feeling of well being (Keller 2004). Theoretically, these supplements should help the body to perform better, when under stress, fatigue, or performing physical exercise. Red Bull in suspected link to deaths (BBC News Online 2001) Despite Red Bull ®s beneficial effects, some users have had adverse effects from consuming it, and as many as five people have died. A 16-year-old volleyball player would faint during games, and gain a heart rate increase of 30bpm. Diagnosed with postural tachycardia syndrome, she told the doctor that during the week she would drink four to five cans of Red Bull ® daily. Returning to normal a month later having stopped drinking Red Bull ®, doctors believed that high concentrations of taurine in the brain might have interfered with her cardiovascular system (Terlizzi et al. 2008).1 In 2001, an 18-year-old basketball player shared four cans of Red Bull ® with friends, played a game, then later died of Sudden Adult Death Syndrome. An investigation was recommended into high caffeine content drinks (Medicalnewstoday.com 2004). Two clubbers died in 2001 after drinking Red Bull ® with vodka, a third died after drinking it after extreme physical exercise. No results were published into the relationship between Red Bull ® and their deaths (BBC News Online 2001). A WalMart shelf stacker with a heart condition would drink four cans of Red Bull ® a night. He later died of a heart attack. The coroner had insufficient evidence to link the death with Red Bull ® (Clarke 2008). Most major brands will open up to consumers if there is a health scare or death related to their products, in an effort to safeguard brand loyalty (Dunne 2005). Red Bull ® prefers to take the offensive; No one anywhere has ever shown any link between Red Bull energy drink and harmful effects (Medicalnewstoday.com 2004). This makes them appear edgy, flaunting their dont mess with us attitude. 3.3 Has Red Bull ® profited from controversy? Debate surrounding Red Bull ® has been a double-edged sword. On the one hand, they loose some customers due to health fears, as countries such as Denmark, France, and Australia ban the drink. On the other hand, along with the bans, negative press rel ated to the ingredients, nicknames, adverse affects and deaths, has not only made Red Bull ® a talking point, giving them free publicity, it has also allowed the drink to keep its edge, and remain cool. As Mateschitz himself points out; Without the old high school teacher telling his students Red Bull is evil probably even a drug it wouldnt seem interesting and therefore would loose its edge (Kumar, et al. 2004). This edge was proved during Red Bull ®s launch in New Zealand. The distributor was selling a version of the drink with a UK health warning that the government did not recognise. To get round this, they re-labelled each of the 70,000 cans. When consumers found out that the authorities disapproved, demand went through the roof punters would buy Red Bull and immediately pull off the sticker. Theyd tell their mates: this stuff is illegal, everyone wanted to be drinking from the forbidden tin (Cooney 2007). 4.0 Red Bull ®, a non-descript market? Mateschitz believed consumers would take Red Bull ®s benefits seriously only if the product cost more than an average soft drink. Therefore from the outset, the cost per can was set 10% above the most expensive competitor, regardless of country. This is why a single can of Red Bull ® can cost up to 300% more than a traditional soft drink (Keller 2004). Conducting initial market research in 1987, Red Bull ® had failed miserably; people sa id its colour and taste were disgusting (Johnson 2002). However, this was not all bad news, further research revealed; 50% of our test group were crazy about Red Bull, and 50% said it tasted terrible (Johnson 2002). Ambivalence, as Mateschitz later says, was great for Red Bull ®, creating discussion, controversy and giving Red Bull ® the edge it needed to start a new market. Some thought it had a medicinal taste, persuading consumers of its functional properties and added value (Keller 2004 p117). The drinks extra cost would not deter them (Keller, 2004). Red Bull ® describes its market as; more than just a hot secret for the night owl and the non-stop party-animal. It is appreciated by a wide range of people, such as the overworked taxi driver, the stressed manager, the exam-anxious student and the pressured journalist It is used by surfers in the summer and snowboarders in the winter (Redbull.com (d), [ca. 2009]). Companies typically select their consumer group by specifying such target elements as age, job, sport, or occupation. Red Bull ® does the contrary. Whilst talking generally about their consumers, stressed student, taxi driver, stressed manager etc, they manage to keep their market relatively vague (Walker, [ca. 2009]). So the question is, who buys such a strange tasting, expensive product, with benefits deliberately not spelled out in black and white? Rob Walker [ca. 2009] argues what Red Bull drinkers have in common is a taste for the edgy and faintly dangerous. Keeping a question mark over the specific consumer allows drinkers to fit into the Red Bull ® clique. Despite the young hip image, Red Bull ®s non-descript credentials allow it to be consumed by just about anyone, creating access to wider markets and competitive advantage (Walker [ca. 2009]). 5.0 How is Red Bull Marketed? Red Bull ® presents an image of a small, friendly enterprise. We dont want to be seen as having lots of money to spend (Walker [ca. 2009]). The truth however is quite the contrary. The company spent $600 million, or 30% of its revenue on marketing in 2004, Coke spends 9% (Dolan 2005). This huge sum is spent on extreme sport sponsorship, live events, and eye-catching design, with less emphasis on media advertising (Gschwandtner 2004). This section asks how and why they use these techniques. 5.1 Sponsorship Red Bull ® sponsors over 500 extreme sports athletes worldwide. Examples include Formula 1 Freestyle Skiing, Break Dancing, and Free Climbing (Gschwandtner 2004). Additionally, Red Bull ® creates events filling every niche, from DJ battles, Whacky Races, Air Shows through to Festivals. (Gschwandtner, 2004; see page 10) In 2003, 200 million people watched worldwide as B.A.S.E. jumper Felix Baumgartner leapt from a plane at 30,000ft above Dover with a carbon wing strapped to his back. He flew the 22 miles across the English Channel to Calais at an average of 135mph, setting a new world record (Wyatt 2003). The stunt was not only a dig at the outlawing of Red Bull ® in France, but also a pre-marketing strategy to create brand recognition and a buzz about the product (Gschwandtner 2004). Red Bull ® has tapped into the market of the rich and famous by purchasing Jaguar and Minardi Formula One teams in 2004 and 2005 (World Advertising Research Center 2009). Costing over $100 millio n a year and competing around the world, they race under the names Redbullracing and Torro Rosso (Forbes.com [ca. 2009]; World Advertising Research Center 2009). With constant media coverage, and cans of Red Bull ® spotted in the hands of celebrities and the logo splashed all over their cars, Red Bull ® wins even if the two teams lose! The 5500m2 Hangar-7 in Austria diversified Red Bull ®s influence. It is home to the 15 Flying Bull show planes, a chic eatery, and art exhibition. By night, it transforms into a nightclub, with Vodka Red Bull ® on tap (Redbull.com (b) [ca. 2009]). Dedicated pre-market research allows Red Bull ® to tailor events and sponsorship specifically to each consumer group, state by state, country by country, seamlessly. 5.2 Advertising Simple, playful, nonsensical cartoons help market the product at anyone with a sense of humour, regardless of language, reaffirming Red Bull ®s nebulous marketing strategy (see bottom of page) (Keller, 2004). Coupled with the tagline Red Bull gives you wiiings (Keller 2004, p119) a deliberate exaggeration, adding intrigue, it makes the consumer eager to find out for themselves (Walker [ca. 2009]). 5.3 Brand Image Two red coloured bulls charging towards one another. Mateschitz admits,we dont bring the product to the people, we bring people to the product (Gschwandtner 2004). Page | 10 6.0 Revolutionary Marketing This section explores the revolutionary marketing techniques Red Bull ® uses to establish its brand. The techniques developed out of a demand. In 1987, Red Bull ® could not be exported from Austria, as it was not a European Union member state. EU law states that if one country agrees to the sale of a foodstuff, it can be sold in all EU countries. Each EU member state has a list of allowable ingredients, and to Red Bull ®s dismay, taurine was on none of them. Scotlands allowed list did include taurine, so Red Bull ®s first EU market entry was in 1992 in the UK via Scotland (Keller 2004). During the EU ban, with demand high, individuals bootlegged the drink across borders. Red Bull ® was not actually on the black market, but bootlegging did help their semi-legal image (Keller 2004). Red Bull ®s entry to the UK market was rocky. It was not until 1995 that they made profit (see Figure 2). Red Bull ® was sold as a sports drink, not the holistic product seen in Austria. Instead of using the known buzz marketing, Red Bull ® sold through supermarket chains and billboard advertising with a new tagline: you should never underestimate what red bull can do for you (Johnson 2002, p.5). Their share of the market only stood at 2% (Johnson 2002). (Red Bull Mini 2008) Firing the entire sales team, Mateschitz appointed an Austrian director who increased marketing spending (see Figure 2). The slogan was changed back, and Buzz marketing was introduced. Teams of students were hired to tap into the younger markets. Driving Minis with big Red Bull ® cans attached, they attended parties, and social gatherings. These alpha bees would be the popular ones of friendship groups. If they liked the product, so would their friends, creating a buzz about Red Bull ® (Gschwandtner 2004). This coupled with sponsorship of extreme sports meant that between 1998 and 1999 profits after tax went from  £85,000 to  £16 million (see Figure 2) (Red Bull Company Ltd 2009). A similar success story was of Kiwi, Joseph Roberts, who, when on holiday in Slovenia, saw the opportunity to market and sell Red Bull ® back home. Out partying, he decided he wanted a soft drink and stumbled upon a can of Red Bull ®. When the bar man refused to sell it claiming it to be illegal , it made him want it even more. Eventually, he spent no less than $150 on three cans! Drinking just one, he realised its potential. A year on he met with Red Bull ® in Austria. On persisting, he gained rights to sell the drink. Back in New Zealand, his marketing strategy ensured Red Bull ® turned up at the right parties, bars, and shops. By playing the drinks illegal credentials, he used opinion leaders to create a buzz about the product (Cooney 2007). Before he knew it, he was rushed off his feet: We were delivering products from the back of our cars at two three in the morning everybody had to do whatever it took (Cooney 2007, P.5). Buzz marketing evolved during Red Bull ®s USA launch in 1997. Organising sales, marketing, and distribution from the Red Bull ® North American California HQ was impractical. Instead, a structure similar to that of Red Bull ® GmbH split the USA into eight units covering a set amount of states (see Appendix Figure 3). Each unit organised sale s, distribution, and pre-marketing. This meant the buzz was created even before Red Bull ® arrived. The alpha bees would poll consumers interests, for Red Bull ® to promote the drink in the right places and sponsor the right events (Hein 2001). 7.0 Maintaining market share Red Bull ® dominated the global market in 1987. By 2008 however, they still led with 29%, but energy drink company Monster was catching up with 23% (The Nielson Company 2009). The next section explains how and why, it changed. In 1987, UK Lucozade and USA Gatorade, although not specifically energy drinks, crossed over into Red Bull ®s territory, having already been on sale for many years. Equally, Kratin Daneng held a market share in Asia, although not in carbonated form (Gschwandtner 2004; Kumar, et al. 2004). With over 228 brands listed in 2008, the picture had become very different. Energy drinks were an extremely complex market area. In can or re-sealable bottled format, the sizes varied from the slim original 250ml, to the new 300ml and 680ml varieties. Products now ranged from regular carbonated energy drinks through to Energy Shots with 25 new versions in 2008, natural organic non-carbonated forms, and aphrodisiac drinks (The Nielson Company 20 09). In 1997, Hansen Natural brought out Monster Energy, using similar marketing techniques as Red Bull ®. With a similar calorie count, and blend of ingredients it resembles Red Bull ®, yet is double the size and half the price, it was bound to sell well (Johnson 2002; Monster energy [ca. 2009]). Coffee energy drinks recently entered the market, such as SHOCK coffee (Johnson 2002; SHOCK coffee [ca. 2009]). However companies including Red Bull ® had already tried similar products without success, Fair Trade energy drinks are likely to be a popular new market entrant (The Nielson Company 2009). 8.0 Competition and Intellectual property Energy drink companies have ridden the wave of Red Bull ®s success bringing out similar looking products. No patent on the drink means even their taste could be the same allowing competitors to undercut Red Bull ® and take some of their market share. How has Red Bull ® protected its brand image in the now turbulent functional drinks market? Red Bull ® is a registered trademark. Extremely protective of its brand image, strict guidelines govern the ways Red Bull ® portrays itself in advertising; from use of colour to font size, they cover it all. These measures deter copycat brands but it does not always work; (Keller 2004) In 2007, Red Bull ® took rival energy drink Boost to court, saying their cans use of silver and blue infringed the Red Bull ® trademark. The images on the right hint that Red Bull ® won. (Irish Independent 2007). Red Bull ® took Music Festival organiser Mean Fiddler to court in 2004, claiming firstly that t heir energy drink Synergy had infringed their trademark with silver and blue patched cans of similar size. Additionally they believed Synergy had been switch selling. Losing the court case, Red Bull ® paid out  £20,000 in court costs (Sweeny 2004). Australian wine company Reschke Wines bid to register the trademark Bull Traders in 1999 featuring the outline of a bull. The two companies went to court over the issue (Ainslie 2008). 9.0 Discussion Selling over four billion cans worldwide last year and with global sales figures up on 2007 by 13.2% Red Bull ® remains optimistic of its future. 2009s plans to expand into new and emerging markets such as Africa, Russia, India, and Japan remain unchanged (Mà ¼ller, 2009). However Red Bull ® is not the only energy drink company weathering the economic crisis so well. Reports predict an increase in global energy drink sales by more than two thirds in 2014, at over 8 billion litres annually (Canadean Ltd 2009). What are Red Bull ®s p lans to maintain dominance in the energy drink sector and increase revenue, especially in these times of economic downturn? (Reschke Wines [ca. 2009]) (Boost [ca. 2009]) Page | 14 9.1 Diversification of product range When companies start out with one product, they later diversify or update the existing range to keep consumer interest, ensuring their product does not reach maturity too soon. Red Bull ®s sales figures are still growing, even after 22 years. Their uniqueness on entry into the drinks market as an energy drink has given them 16 long years before they felt the need to diversify (see Figure 5). Successes and failures of products Red Bull ® has brought out are described below. With over one in four adults in the UK trying to loose weight most of the time (Talking Retail 2008, p.1), Sugar Free Red Bull ® was launched in 2003. It contains only 8 calories when compared to the 110 of standard Red Bull ®, so taps into the emerging health conscious (Moosa 2002, p.32) market (Caloriecount.about.com [ca. 2009]). With 25% of new buyers in the UK purchasing Sugar Free Red Bull ®, it accounted for 15% of 2008 sales, Red Bull ® intends to increase spe nding on advertising its sugar free variant (Talking Retail 2008). Sabai meaning take it easy (Centaur Communications Ltd 2007, p.1) fits their marketing ethic, being a bespoke wine, it is sold using point of sale promotion and consumer sampling at events with celebrities to create a Sabai buzz (Forbes.com [ca. 2009]; CentaurCommunications Ltd 2007). Lunaqua was a failed Red Bull ® attempt to enter the bottled water market. First seen in 2001, the drink was bottled from a previously undiscovered Alpine Source (Lunaqua [ca. 2003]) at full moon giving the water bio-energetic (Lunaqua [ca. 2003]) properties. Suffice to say, it did not sell well and was withdrawn (World Advertising Research Centre 2009). Page | 15 For 2009, Red Bull ® plans to bring out an Energy shot to oppose the 25 competing products brought out in 2008 (BevNET.com 2008). 9.2 Drinks for the Health Conscious consumer Led by the increasingly health conscious (Moosa 2002, p.32) consumer, the market is still developing. With sales volume doubling from 25 million in 2000 to 50 million litres in 2002, Red Bull ®s entry into this niche had to be profitable. Relatively fragmented, it covers a wide variety of products, from vitamin and mineral enriched herbal drinks though to pro-biotic yogurt and fruit drinks, to fruit enriched smoothies (Hillam 2003). Owned by Red Bull ®, Carpe Diem sells a range of five drinks. Kombucha developed in 1997 and Ginkgo 2000 are modern-day carbonated versions of ancient Asian herbal teas. Kombuchas influences stem from the ancient philosophies of Zen, which aims to harmonise body and soul. Ginko has origins in myth and legend, containing leaves from Asias sacred tree, the Ginkgo Biloba aids conc entration. (CarpeDiem.com (a+b) [ca. 2009]. Homeopathic drinks, made with spring water, herbs and plants were launched in 2003. Drawing on Greek physician Hippocrates theories, they have relaxing, harmonising, or vitalising effects and are 100% natural with no added sugar, flavours, colouring or preservatives (CarpeDiem.com (c) [ca. 2009]). Carpe Diems elusive nature echoes Red Bull ®s marketing strategies. By using very little promotion such as point of sale in Selfridges, collaborating with masseurs, offering holistic solutions to weary shoppers, they let consumers find the product, re-creating that Red Bull ® buzz (CarpeDiem.com (d) [ca.2009]). The Wellbeing Zone on the Carpe Diem website details participatory events like urban Yoga, and an Osteopathic self-treatment programme run by experts (CarpeDiem.com (d) [ca.2009]). Like Red Bull Carpe Diem are securing income by creating a way of life, ensuring consumers buy into a philosophy: an appeal to the people of our time to li ve consciously and seize the day (CarpeDiem.com (e) [ca.2009]). (CarpeDiem.com (d) [ca.2009]) (CarpeDiem.com (b+c) [ca. 2009]) Page | 16 The Red Bull simply COLA ® 2008 launch was extremely controversial. Including ingredients such as the Kola nut and Coca leaf, the drink is sold as the only cola to be organic, taking the drink back to its roots. Adding diversity, the drink is available in 250ml and 330ml can sizes (World Advertising Research Centre 2009). In contrast to Red Bull ®s Buzz marketing technique, the launch covered eight markets worldwide including Austria, UK, Ireland, USA, Russia, Germany, Italy, and Switzerland (Redbullcola [ca. 2003]; World Advertising Research Centre 2009). 9.3 New Marketing Ideas (Redbullcola [ca. 2003]) In 2008, Red Bull ® invested only  £50,000 of its  £7.6 million budget in digital marketing, a number set to increase in 2009 (Revolutionmagazine.com 2009). Below are some examples: Red Bull ® entered the gaming industry in 2008 as the first advertiser on Playstations virtual world. Playing an online version of the Red Bull ® Air Race, users interact and share gaming experiences, adding publicity (Revolutionmagazine.com 2009). The Facebook Red Bull ® partnership in launching the new Facebook Connect site enables users to access all their social networking sites using just one login and password. With Facebook being visited by 3 in 10 people online across the world and social networking sites capturing 67% of the global online population, this partnership offers a low-cost way to advertise to hundreds of millions more consumers (The Nielson Company 2009) 9.4 Expanding the business model Red Bull ® purchased the paradise island of Laucala in 2003 for $10 million. Matesch itz association with the rich and famous will ensure a steady flow of customers for the seven star resort, furthering the drink companys credibility with consumers (Fijilive.com [ca. 2009]). In 2004, Selling Power reported Red Bull ®s intention to create a $1 billion motorsport and aviation theme park in Styria, Austria. Open-air arenas holding 100,000 onlookers, F1 racetracks, as well as a motorsport and aviation academy, are just some of the features. In a hierarchical company, instructions are generally passed down from one person to another until it gets to the bottom. If there was a problem in a hierarchical structure it would move up through the structure again from one person to another until it gets to where it is supported to be. Strengths of a Hierarchical structure In a hierarchical structure there is a close control of workers. Workers in ASDA will know exactly what they have to do so they don’t wait around until they are told what they have to do. There is a small span of control. A span of control is when an amount of people report to one person. Also there is a better chance for promotion. Weaknesses of a Hierarchical structure In a hierarchical structure information is slow moving. There may be poor communication between departments. Also workers may not feel involved in the business and they may not feel motivated to work. The types of communication used in a Hierarchical structure The type of communication used is hierarchical will be more written communication. It will be written communication because the information will have a long way to go before it gets to the person. If it was verbal then when the message gets passed on it will change along the way. Any problems in communication and how I can solve it The problem with communication in hierarchical will be: communication will be slow, might not reach its destination and the information might change. Possible solutions: if the information is slow then maybe you can e-mail the person and then the information will get there faster. Explorers of Africa :: Geography

Explorers of Africa Mungo Park was a Scottish explorer who led one of the first expeditions to investigate the course of the Niger river in Western Africa. Mungo Park was a 23 year-old scottish surgeon who had just returned from a journey to Sumatra on a ship of the East India Company. There he had discovered 6 species of fish, and he had published descriptions in a Scientific Journal. In 1795, Park had gone to Piscina, on an offer to research further into Africa. Park had accepted and a severe fever overcame him during his journey. Park also had been captured by certain muslim leaders. After he had gotten out of the Prison he had wandered around and had finally found the Niger River. Park was amazed at how beautiful the River was. Park had stated "I saw with infinite pleasure, the object of my, mission". Park had returned home to London where became famous on his publications of his voyage across Africa. Later in 1806 he sailed downstream to the Bussa rapids, where he drowned, trying to escape an attack by the Africans. Rene Callie was a 27 year old man who was fascinated by the stories told about peoples travels to Africa. His readings of Mungo park also stimulated his fascination. Callie had entered a contest for the first person to reach Timbuktu and reach back. He had reached Timbuktu. During Callie's trip he did not find it easy to prove to the French Authorities that a young man with no experience could discover Timbuktu. On his way back Callie had joined a Arab Caravan preparing to cross from Western Sahara to Morocco. Callie had stated "I am the first European to cross from the sandy ocean from the south to the north". On his return to Paris, Callie was known as a hero. Later, questions were asked if he was telling the truth or not. Johann Rebmann Johann Rebmann was a German missionary, who was not like Mungo Park or Rene Callie. The Deceitful George in Of Mice and Men Steinbeck gives a lot of reasons for George to stay with Lennie, but his critics also have some merit in their criticism that the story isn't believable. Steinbeck's critics suggest that Steinbeck is "simply sentimental in this regard." There are some very compelling reasons George would like to stay with Lennie... but being "sentimental," towards Lennie has nothing to do with it. George and Lennie's ultimate goal is to "get the jack together," buy a few acres of land they can call their own, "an' live off the fatta the lan' (pg. 14)." George talks in great depth about how their dream house is going to have individual rooms, a kitchen with a fat iron stove, and an orchard. But, George only recites this yarn when he wants to get Lennie calmed down. Lennie has the mentality of an 8 year old, the memory of a senile 80 year old, and only desires to tend rabbits. George fully understands that Lennie can easily be manipulated. Even though the dream to have a piece of land is shared, George knows that by himself he cannot amass a large enough "stake," to buy it himself (pg. 33)." Just as the boss thought, George was "takin' his pay away from him (pg. 22)." Throughout the story George recites a description of how easy his life could be if he didn't have to keep up with Lennie. "God a'mighty," he could "get a job, an' work, an' no trouble (pg. 11)." At the end of the month, he could take his 50 bucks and go into town and buy whatever he wanted. George says these things like he's only teasing, but in actuality he's dead serious. George started building his alibi when he first arrived at the farm. He wanted to seem like he deeply cared for Lennie, and that Lennie was an overall good person. George then strengthened his alibi, and gave a glimpse of his true motives when he talked to George about why he stopped making fun of Lennie. Explication of ‘Leningrad Cemetery, Winter of 1941' This poem is about the World War ? especially in Leningard(1941. 09. 08~1944. 01. 18) in winter of 1941. Leningrad which is now St. Petersburg is once former capital of Russia and Russian Revolution so it was strategically important place for Hitler to have war with. German army siege this city almost 900 days and over 650,000 people are dead from this war because of starvation, exposure, disease and so on. However, Leningrad did not surrender against the enemy and bear all hardships and difficulties, later called ‘city of hero'.How extremely difficult and severe situation it was in World war ? is depicted in this poem. There are a lot of dead bodies needed to be buried but impossible because ground is frozen and grave digger became weak from hunger. Also coffin could not be made because there was lack of fuel to heat and wood should be used for fuel. Instead of coffin they put the corpse on the child's sled and take it to the cemetery. Child sled is the symbol of joy and happiness in winter snow but in the war time that kind of joy is disappeared but only degenerated to tool of moving the dead body.There are some analogies with the dead. Speaker of this poem is third person narrator so hard to know the dead's mind exactly however we could analogize their thoughts on their death.They would want to come back to life even if they have to eat the bread made of glue and sawdust and live in the severe cold and siege. ‘Bread made of glue and sawdust' is nonsense but it means stale bread that is so dry and hard to eat. Narrator says having a life is better than death even if it becomes hard or difficult. It shows us that they really didn't want to die in the war and life is so precious itself. It is composed of only one stanza. It makes reader to be focused on the situation that writer explain with tension.Omniscient third person narrator speaks in the poem so we could not hear their direct voice but relying on what speaker says.
